ISLAMIC SOCIETY OF SOUTHEAST KANSAS Constitution

Article 1

DEFINITION

 NAME& NATURE:

The organization shallbe called the Islamic Society of southeast Kansas, hereinafter referred to asISSEK.  The ISSEK is guided in all itsactivities and practices by the Holy Qur’an and the traditions of the prophetMohammed (PUH).

STATUS

 ISSEK  shall be a non-profit religious organization.It shall function according to the frame work of 501 (c) (3) of InternalRevenue tax code as a tax exempt organization.

LOCATION

The current locationof ISSEK is, on the intersection between HWY 400 and 69 S. mailing address:1296 S. 220 th St. Pittsburg, KS 66762

Article 2.

ISSEK MISSION 

The Islamic communityof Southeast Kansas, southwest Missouri and northeast Oklahoma, has establishedthis organization in order to achieve the following:

  1. To enable Muslims to adopt Islam as acomplete way of life. To assist and guide Muslims to perform the Islamicobligations. (Pillars of Islam and all the fundamentals of Islam).
  2. To serve the best interest of Islam inSoutheast Kansas, southwest Missouri and northeast Oklahoma. To promoteunity and brotherhood among Muslims.
  3. To bring about better understanding of Islamas a comprehensive Deen (way of life).
  4. To reach out in order to present Islam, andrepresent Muslims.
  5. To assist and guide Muslims to practice theIslamic concepts as described in the Holy Quran and the tradition (Sunnah)of Prophet Mohammed (PUH).
  6. To cooperate and associate with other Islamicorganizations having similar objectives within the framework of thisSociety's constitution.
  7. To establish and maintain weekend Islamic andArabic Education.
  8. To establish and maintain ISSEK facilities.

Article 3.

ISSEK Methodology:

Thefollowing methodology will be used to attain the Mission listed above:

  1. Manage the Masjid (mosque) of ISSEKeffectively.
  2. Establish an effective Da’wa program.
  3. Establish an Islamic Trust Fund in order tobecome self-sufficient and support the various ISSEK projects.
  4. ISSEK shall only use Shura (consulting themembers), peaceful, and Islamic means to attain its goals.
  5. ISSEK shall make necessary financialarrangements to accomplish its mission. 

Article 4

ISSEK Structure

The ISSEK shallcomprise of the following:

  1. The General Assembly of Muslims inSoutheast Kansas, southwest Missouri and northeast Oklahoma.
  1. The Executive Committee
  1. Sub-committees formed by the ExecutiveCommittee.

Article 5

The General Assembly

The membership of the ISSEKshall consist of persons who wish to abide by this constitution and satisfy themembership requirements. ISSEK Masjid is open to every Muslim regardlessof membership status. All elected members of Executive Committee must bemembers of the ISSEK. All the members of the ISSEK have theprivilege of using the facilities. Members must follow the procedures andpolicies outlined by ISSEK.

Executive Committee isresponsible for approving the memberships and keeping track of the member'sinformation. General Assembly meetings will be held semi-annually. ThePresident/Amir of the Executive Committee will present his report. If the needarises, a General assembly meeting can be called upon by filing a petition tothe Executive Committee, duly signed by one-third of the members.

Article 6.

Membership

Any Muslim who wishes to becomea member of ISSEK must meet the following requirements:


believesin Islam as a total away of life, believes in one God (Allah) and MuhammedPBUH as Allah's last messenger to mankind.


mustcomplete a membership application form if 18 and older.

ExecutiveCommittee has the right to make the final decision in applying the abovecriteria

associate Member : non-Muslim,who completes the application form, and approved by the Executive Committee.

All members shall be entitledto vote, and are eligible to hold an office in the Executive Committee inaccordance with criteria established elsewhere in this constitution.

Membership shall benon-transferable and non-assignable.

Membership may be withdrawn ifa member has disregarded the provisions of this constitution or Islamic values.Such preceding may be initiated on a written request by five or more members ofthe Society's general members and decided upon by the Executive Committee.

Article 7

GENERAL ASSEMBLY FUNCTIONS

a.TheGeneral Assembly shall be the supreme organ of the association and it shall beconstituted of all members of the association.

b.TheGeneral Assembly shall make all its decisions by a simple majority of votes ofmembers present, except the conditions specified in articles 11, and 12.

c.The quorum of the General Assembly meetings shall be formed by one third of thetotal number of the members, fraction being counted as one.

d.All transactions of the General Assembly shall be conducted through voting.

e. Anemergency meeting of the General Assembly can be hold at the request of thepresident, two Executive Committeemembers, or one‑third of members.

Article 8

ExecutiveCommittee :

a.Theterm of the office of the Executive Committee member shall be viewed annually.If two third of the general assembly votes warrant a continuation it shallcontinue for another year, otherwise new election shall be held.

b.Executive Committee needs to meet bi-monthly (once every two months) minimum.

c.The Executive Committee shall also meet whenever called by the President orupon the request of at least two Executive Committee members, or one-third ofthe ISSEK members.

d.Any Executive Committee member who would not attend three successive meetingsof the Executive Committee without a reasonable cause, and prior notification shall be replaced by a new memberelected by the General Assembly at its next meeting.

e.In the event of any vacancy, the Executive Committee shall fill the position bytemporary appointment. In the next General Assembly meeting, such appointmentshould be approved through normal election procedures.

f.The Executive Committee shall make its decisions by a majority of votes.In case of a tie the vote of the President counts twice as much as thevote of each of the other officers.

g.The Executive Committee shall be responsible to the General Assembly.

h. TheExecutive Committee shall be responsible for managing the affairs and theactivities of the ISSEK and for executing the decisions of the GeneralAssembly.

I.Smallfunctional committees may be appointed by the Executive Committee as needed.

Article 9

Functions of the Executive Committee

  1. The Executive Committeeshall be responsible for overall direction of the ISSEK by assuring adherenceto the Islamic teachings.
  2. The Executive Committee shall determine andmaintain the independence and the integrity of the ISSEK and its holdings,which will be consistent with the teachings of Islam and the best interestof Muslims in Southeast Kansas, southwest Missouri and northeast Oklahoma.
  3. The decision of the Executive Committee willbe final, unless challenged by the majority of the members of ISSEK.At that time, the matter will be resolved by 2/3 majority of the generalassembly, if not possible, an outside arbitrator (society adviser) shallresolve it.
  4. Executive Committee controls the short andlong-term account of money collected for projects. Executive Committeewill be responsible for filing taxes with the IRS
  5. Executive Committee should issue a summarizedfinancial report and post it, or/and e-mail it, or mail it to the members.   

Article 10

DUTIES OF 0FFICERS:

a.President: shall be responsible for the overall activities of ISSEK;shall represent ISSEK in the community; shall preside at the General Assembly andthe Executive Committee meetings; shall conduct the election of new officers;shall act as liaison  between thisassociation and similar organizations (e.g., Islamic societies in the UnitedStates and Canada) and shall present a complete written annual report ofactivities to the General Assembly.

b.Vice‑President: shall assist the President in his duties and shallassume the duties of the President in the event of the President's inability tofulfill his duties.

c. General Secretary:shall be responsible for all correspondence, for preparing the agenda of themeetings with the President, for recording the meetings, and shall assist thePresident in the discharge of any other duties.

d.    Treasurer: shall be responsible, forall financial matters of this association, and shall handle the funds with theapproval of the President. He shall maintain the financial records and shallpresent a complete written annual report of the audited finances to the GeneralAssembly. The finances shall be audited by an auditing committee of threemembers duly elected by the General Assembly excluding Executive Committee members.

e.Other positions created by the Executive Committee.

Article11

Amendments

A.This constitution shall go into effect upon its ratification by a two‑thirdsmajority of the total members present and voting.

B.Any proposed amendment in the constitution shall be given to the secretary inwriting.

C. The secretary shall thenpresent the amendment to the Executive Committee, which in turn shall presentit to members for discussion

D.A2/3 majority of the quorum present at the meeting when a proposed amendment ispresented shall decide the acceptance or rejection of the amendment.

Article 12

Dissolution:

Dissolution of the ISSEK:A three-forth majority of the General Assembly and Executive Committee membersmay agree to dissolve the ISSEK in a meeting called for that purpose.Two weeks notice for a meeting will be mandatory. At least one-third of theGeneral Body members shall ask Executive Committee for such a meeting. Thisaction of the General Body members shall be then considered by the ExecutiveCommittee.

Upon the dissolutionof ISSEK, the Executive Committee shall donate of all the assets of the Society exclusively for the purpose of the Society in such manner, or to suchorganizations, which are organized and operated exclusively for charitable,educational, or religious purposes.

For the dissolution tobecome final a three-forth majority of the total General Body members of ISSEK shall have to agree affirmatively in meetings held separately from theExecutive Committee.
